David S. Pollack

David S. Pollack is Trial Counsel for Winkler Kurtz, LLP and known for his exceptional knowledge of trial proceedings and courtroom techniques. Trying personal injury and medical malpractice cases exclusively for plaintiffs during his entire career, David’s dedication to advocating for individuals who have been wrongfully injured has secured millions of dollars in awards for his clients to compensate for their losses.

David has over 35 years of experience in plaintiff malpractice law to offer his clients, giving them a significant advantage when seeking justice for severe and traumatic injuries. He has tried over 70 complex medical malpractice cases to verdict in his career, obtaining numerous multimillion-dollar results. While fellow trial attorneys admire David for his skilled practice in the courtroom, he is highly regarded by his clients for his genuine compassion and ability to keep them informed on their case every step of the way.

One of David’s most noteworthy cases resulted in a 13.6 million dollar verdict in Elmira, New York against a maternal-fetal medicine specialist for failing to avoid prematurity resulting in Cerebral Palsy. In another case in Queens, New York, David secured a 7-million dollar verdict against a general surgeon for delaying a diagnosis of breast cancer. For his outstanding achievements and commitment to his clients, David has been honored with listings in “The Best Lawyers In America,” “SuperLawyers,” The National Trial Lawyers “Top 100 Trial Lawyers,” as well as receiving an AV rated by Martindale-Hubbell, with “Preeminent” status for 20 years.

With a deep passion for the law, David has volunteered his time on multiple occasions. David served as a member of the Board of Directors of the New York State Trial Lawyers Association for nine years and was an active participant of the Member Judiciary Committee for the Nassau County Bar Association for six years. Furthermore, he volunteered as the attorney adviser to the High School Mock Trial Team in Port Washington from 1994 until 2012.

David’s impressive knowledge and expertise have made him a sought after lecturer of many topics related to prosecution of medical malpractice cases and a desired trial counsel for major personal injury and medical malpractice firms. He has authored several chapters in legal publications, including most recently a chapter entitled “War Stories: The Oral Tradition of the Trial Bar,” Medical Malpractice in New York, Bob Devine, Ed. David also authored a monograph entitled “A Pocket Manual for Putting Things in Evidence,” which appeared in the Trial Lawyer’s Quarterly.

Admitted to the Bar in 1981, David concentrates his practice in the areas of medical malpractice, personal injury, birth injuries, and wrongful death. He has successfully represented clients suffering from serious and catastrophic injuries on many occasions, holding negligent parties legally responsible for all damages caused by their actions. Some of the case types David has tried over his career include obstetrical malpractice, delayed diagnosis of cancer, wrongful death due to medical negligence, and surgical errors.

Born in the Bronx, David graduated from High School in Great Neck, New York and obtained a Bachelor’s degree from Boston University, graduating with honors. He earned a Juris Doctor degree in 1980 from New York Law School, where he was a member of the moot court executive board and co-chair of the national Robert F. Wagner Labor Law Moot Court Competition. David began his career working for the firm then known as Pegalis & Wachsman while he was in law school. David became associated with Winkler Kurtz, LLP in 2014.
